To facilitate the participation of parties in the administrative adjudication procedure and standardize the online oral hearing work of administrative adjudication cases, the National Intellectual Property Administration (CNIPA) recently formulated and issued the “Online Oral Hearing Method for Administrative Adjudication Cases of the National Intellectual Property Administration” in accordance with the relevant provisions and work practice of administrative adjudication.
It is understood that in 2022, the National Intellectual Property Administration thoroughly implemented the decision-making and deployment of the Central Committee and the State Council to comprehensively strengthen intellectual property protection, strengthened the central authority of intellectual property protection, and actively organized the administrative adjudication work of major patent infringement disputes and early resolution mechanism for medical patent disputes, in accordance with the relevant provisions of the newly revised Patent Law, and concluded the first batch of two administrative adjudication cases of major patent infringement disputes and 70 administrative adjudication disputes of medical patents with early resolution mechanism. Online oral hearing is advantageous in its convenience in participation, the high efficiency, and less cost in transportation and travel for the parties, and may also reduce work load in the hearing procedure. The formulation and issuance of the method will further standardize the online oral hearing work of administrative adjudication cases, reduce the cost of rights protection, and improve administrative efficiency.
Next, the National Intellectual Property Administration will better its job in the trial of administrative adjudication cases in accordance with the law and regulations, in an effort to effectively safeguard fair competition and order of market, and effectively protect the legitimate rights and interests of intellectual property rights holders and the public.
