Chang Type Industrial Reached 3.5 Million Reconciliation with Bosch

Recently, electrical machinery company Delta Power Equipment Corporation, a subsidiary of Change Type Industrial Co., Ltd. of Taiwan, announced the settlement of the patent infringement lawsuit with Robert Bosch Tool Corporation. The subsidiary will pay Robert Bosch $3.5 million as a settlement fee. 

It is reported that the patent involved in this case is the No. 10207345 patent owned by Robert Bosch in the United States.

On November 29, 2021, Robert Bosch LLC sued Chang Type Industrial's subsidiary Delta Power Equipment for patent infringement in the Spartanburg division of the South Carolina District Court in the United States.

Robert Bosch claims that its engineers have made many innovations in fields such as oscillating tools, electric tool accessories, lasers and optical leveling devices, and measuring tools, including innovations related to the miter saw in this case. Robert Bosch sells a variety of miter saw models, including various dual-bevel glide miter saw models, among which the GCM12SD model miter saw is a dual-bevel glide miter saw with a pivoting arm (outlined in red) that allows the operator to extend and retract the blade during cutting operations.

On April 17, 2005, Robert Bosch LLC submitted a provisional patent application covering a new miter saw design. On April 16, 2016, Robert Bosch LLC submitted a non-provisional application, published under the number US2016/0303666, with an image of the new miter saw design as follows: 


Based on these applications, the US Patent and Trademark Office published Patent No. 10,207,345 on February 17, 2019. Bosch considers the 10,207,345 patent to be valid and enforceable and alleges that Delta Power Equipment's manufacture, use and sale of its products without Bosch's permission or authorization infringes Bosch's rights under the 10,207,345 patent.

Bosch believes that Delta Power Equipment sells dual bevel miter saws under the name "Delta CRUZER," at least including models 26-2240 (10-inch size) and 26-2250/26-2251 (12-inch size), and other similar saws (the "accused devices"), that compete with Bosch's miter saws on the market, including the Bosch GCM12SD product mentioned above. Bosch stated in the prior complaint that to its knowledge, the accused devices include miter saws with a rotating arm, including the accused's first, second and third generation designs. The accused devices also include miter saws sold under the brand "Rigid," including R4251 and R4241 sliding compound miter saws.

Bosch alleges in the lawsuit that defendant Delta Power Equipment was aware of patent 2016/0303666 prior to the grant of patent 10,207,345, and that on March 12, 2020, Delta Power Equipment was formally notified of the infringement of patent 10,207,345, but chose to continue infringing Bosch's patent rights. Bosch also claims, based on public information analysis, that Delta Power Equipment sold its equipment to hardware retailers with the intention of placing it on the same shelves adjacent to Bosch's miter saws.

On January 20th, 2023, Chang Type Industrial announced that, based on commercial considerations, it had signed a settlement agreement with Bosch on January 20th, and Bosch would withdraw its lawsuit and damage claims against Chang Type Industrial's subsidiary. Delta Power Equipment would pay 3.5 million dollars for settlement, and both parties would seek future business opportunities. The details of the settlement agreement were confidential and not disclosed based on the confidentiality clause in the agreement.

One year later, the patent lawsuit between the two companies ended with a reconciliation.
