The National Intellectual Property Administration recently held its regular press conference in Beijing, and released the Results of the 2021 National Survey on Social Satisfaction with Intellectual Property Protection. The Results show that among the five indicators of the Survey on Satisfaction with Intellectual Property Protection, the public has the highest satisfaction with laws and policies.
In the process of formulating and revising departmental regulations, the CNIPA actively responds to hot issues, aiming not only to take full advantage of intellectual property rights, but also maintains a fair competitive market environment. In addition to promulgating the Guidelines for Application and Use of Trademark Registration in Catering Industry (Trial), work has also been carried out in standardizing patent application behavior, trademark agency behavior and patent trademark examination and trial standards.
In its effort for the improvement of patent quality, the CNIPA actively promotes the revision of Several Provisions on Regulating Patent Application Behavior. As an important legal basis for confirming and handling abnormal patent applications, the revised Regulations will deal with abnormal patent applications more effectively, improve the examination and handling procedures and make them more open and transparent.
In its regulation of trademark agency behavior, the CNIPA promotes the promulgation of the Regulations on the Supervision and Administration of Trademark Agency, to better the market environment of trademark agency and promote the professional and high-level development of trademark agency industry.
In terms of patent and trademark examination standards, the CNIPA clearly and effectively deals with abnormal patent application behaviors and malicious trademark registration applications that are not for use. In the revised draft of the Patent Examination Guide (Draft for Soliciting Opinions), it is stipulated that the examiner should examine whether the behavior in the process of applying for a patent obviously violates the principle of good faith. In the Guide to Trademark Examination and Trial, a special chapter on the examination and trial of trademark registration applications for non-use purposes is set up to stipulate the applicable elements, considerations, applicable situations and typical cases of trademark registration applications for non-use purposes.
In the next move, the CNIPA will continue to focus on social concerns, actively publicize and implement relevant laws and policies in the field of intellectual property, and issue corresponding guidelines and review policies in a timely manner according to social requirements, hoping to continuously meet the public's demand for higher standards of intellectual property laws and policies.
