CNIPA Gives Briefing on In-Exam Crackdown on Malicious Trademark Registration

On the morning of April 24, the Information Office of the State Council held press conference on China's intellectual property development in 2021. He Zhimin, deputy director of the National Intellectual Property Administration, said that the year 2021 saw continuous cracking down on malicious trademark registration, and special actions against malicious trademark hijack, as well as cracking down on malicious trademark hoarding, which had all gained remarkable results. 

In 2021, the CNIPA cracked down on 482,000 malicious registered trademarks in the trademark examination process, including 60,400 malicious hoarding trademarks and 1,628 malicious trademarks hijacks that harmed the public interest. In the trademark refusal review procedure, a total of 30,000 malicious trademarks were cracked down. In the follow-up procedure, 1,729 trademarks were voluntarily declared invalid ex officio, and the number of trademarks voluntarily declared invalid ex officio was five times the sum of the past 10 years. 

Mr. He said that since the beginning of this year, CNIPA has continuously cracked down on malicious trademark registration. In the first quarter of this year, CNIPA rejected 12,200 malicious trademarks hoarding, rejected 1,628 malicious trademark hijacks, and voluntarily invalidated 707 trademarks ex officio. In two batches of actions, 1,742 trademarks hijacking the Winter Olympics and the Winter Paralympics, as well as their applicants and agencies, were warned and brought to public. 

Mr. He revealed that CNIPA will continue to standardize trademark registration applications to create better environment for marketing operation.
