Beijing Released Plan of Special Action for Intellectual Property Protection of Olympic Symbols for Winter Olympics and Winter Paralympics

In order to better the intellectual property protection of Olympic symbols of Beijing 2022 Winter Olympics and Paralympics, the National Intellectual Property Administration and the State Administration of Market Supervision formulated the Plan of Special Action for Intellectual Property Protection of Olympic Symbols for Winter Olympics and Paralympics.

The major tasks of the Plan include: 

(1) Strengthening the protection of Olympic symbols and Paralympic symbols in accordance with the Regulations on the Protection of Olympic Symbols. The symbols mainly include: the Olympic five-ring logo of the International Olympic Committee, the Olympic flag, the Olympic motto, the Olympic emblem and the Olympic anthem; Proper names such as Olympics, Olympia, Olympic Games and their abbreviations; The name and abbreviation, mascot, anthem, torch shape, slogan, "Host City Name + Host Year" and other symbols of the Olympic Games held in China, as well as the name and emblem of its organization; Other symbols relating to the Olympic Games to be held in China as stipulated in the Olympic Charter and the Host City Contract; Paralympic Games related signs, etc. In accordance with the Patent Law, Trademark Law and other laws and regulations, three-dimensional protection of various types of intellectual property rights such as design patents and registered trademarks of Olympic symbols shall be further strengthened.

(2) No unit or individual shall use the Olympic Symbol for commercial purposes without the permission of the Organizing Committee of Beijing 2022 Winter Olympics and Paralympics, the International Olympic Committee or the International Paralympic Committee.

(3) Strengthening publicity and education, and enhancing the awareness of protection. Making full use of new media channels, focusing on the links prone to infringement and illegality, guiding relevant industries to self-discipline and standardize market behavior, aiming at the specific contents such as the scope and basic requirements of intellectual property protection of Olympic symbols. 

(4) Intensifying the inspection of key areas such as food and beverage, cultural and sports articles, clothing, shoes and hats, ice and snow equipment, especially key commodity categories such as alcohol, souvenirs and toys, and preventing unauthorized use of the Olympic logo as commodity packaging, decoration or trademark. Strengthening the governance of key areas such as buildings, sports venues, tourist attractions, wholesale markets, stations and airports, and ice and snow sports facilities around the venues in the competition area. 

(5) Correctly applying relevant laws and administrative regulations such as Regulations on the Protection of Olympic Symbols, Trademark Law of the People's Republic of China, Patent Law of the People's Republic of China, Advertising Law of the People's Republic of China, Electronic Commerce Law of the People's Republic of China and Anti-Unfair Competition Law of the People's Republic of China. Strictly punishing the infringement of the exclusive right of the Olympic logo by using the Olympic logo for commercial purposes without permission or using an approximate logo that can lead people to misunderstand. Dealing with illegal acts infringing intellectual property rights such as patents and trademarks related to Olympic symbols. Severely cracking down on illegal advertisements that use the relevant elements of the Winter Olympics and the Winter Paralympics to publish advertisements without the permission of the obligee, which may easily mislead people into thinking that there is sponsorship or other support relationship with the obligee and mislead consumers. In accordance with the law, severely cracking down on unauthorized malicious cybersquatting of the names of Olympic champions and other high-profile Olympic athletes as trademarks, thus damaging their name rights and legitimate rights and interests, and unfair competition behaviors that use elements related to the Olympic or Paralympic Games to carry out commercial activities and lead people to misunderstand. Acts suspected of constituting crimes shall be promptly handed over to public security organs.
