According to the opinions of the Supreme People's Court on carrying out in-depth rectification work in false litigation, as of November 10, 2021, where parties reach a mediation agreement before litigation and apply for judicial confirmation, examination shall be observed as to whether the mediation agreement violates the mandatory provisions of laws and administrative regulations, violates public order and good customs, or infringes on national interests, social public interests, and legal rights and interests of other parties. Where content of the pre-litigation mediation agreement involves the confirmation of real rights and intellectual property rights, it shall be ruled off the docket, otherwise the court shall object the application.
