On April 22, 2021, the Supreme People's Court issued the White Paper on Judicial Protection of Intellectual Property Rights in Chinese Courts 2020 (hereinafter referred to as the "White Paper"), which combed and summarized the trial works on intellectual property cases in courts in 2020. The White Paper shows that in 2020, the courts received 52,561 new intellectual property cases such as first instance, second instance and application for retrial, and concluded 52,438 cases, an increase by 9.1% and 10.2% respectively compared with 2019.
In 2020, the Supreme Court received 3,470 new civil cases of intellectual property rights and concluded 3,260 cases, which rose by 38.58% and 64.98% respectively compared with 2019. The local courts at all levels received 443,326 new civil cases of first instance and concluded 442,722 cases, an increase by 11.1% and 12.22% respectively compared with 2019. Those cases include: 28,528 new patent cases, which rose by 28.09% over the same period; 78,157 trademark cases, which rose by 19.86% over the same period; 313,497 copyright cases, up 6.97% year-on-year; 3,277 technical contract cases, an increase by 4.53% year-on-year; 4,723 competition cases, up 14.41% year-on-year; and 15,144 other civil disputes over intellectual property rights, which rose by 34.96%. Local courts at all levels received 42,975 new civil cases of second instance of intellectual property rights and concluded 43,511 cases, which had dropped by 13.54% and 10.67% respectively.
In 2020, the Supreme Court received 1,909 new intellectual property administrative cases and concluded 1,735 cases, which rose by 79.08% and 96.27% respectively compared with 2019. Local courts at all levels received 18,464 new intellectual property administrative first-instance cases, an increase by 14.44% over 2019, and concluded 17,942 cases, which rose by 4% over 2019. Those cases include: 1,417 new patent cases, which decreased by 14.69% over the same period; 17,035 trademark cases, an increase by 17.83% over the same period; 12 copyright cases, which was 4 fewer than in 2019. Local courts at all levels received 6,092 new administrative cases of second instance and concluded 6,183 cases, which decreased by 16.59% and increased by 4.06% respectively compared with 2019. Wherein, 4,828 cases were upheld, 1,214 cases were revised, 2 cases were sent back for retrial, 114 cases were withdrawn, 4 cases were rejected, and 21 cases were handled otherwise.
