In order to focus its attack against malicious trademark scrambling, CNIPA notified and issued the "Special Action Plan against Malicious Trademark Scrambling" on March 24, 2021.
The Plan clarifies its key targets, that is: the acts of malicious scrambling of trademarks to gain improper interests, which may disrupt the order of trademark registration management, and cause adverse social impacts. These acts may include: malicious scrambling of the names of public figures with high visibility, well-known works or role names; malicious scrambling of trademarks or other commercial marks of others with high popularity or strong significance, hence damaging the prior rights and interests of others.
The Trademark Office is responsible for organizing and coordinating the development of special actions. For malicious acts, the Trademark Office will start a quick rejection mechanism at the application stage, and take measures such as early review and trial, joint trial and oral trial of major cases for cases in objection and invalidation procedures, as well as declare of invalidation of a number of trademarks with bad influence, and make public its relevant examination decisions and rulings. Intellectual property management departments at all levels should focus on special rectification according to the clues of cases transferred from higher authorities. Administrative penalties shall be imposed on those who illegally engage in malicious registration of trademarks. According to the Plan, this special action will be implemented from April to October, and it is expected that the special action will be inspected and summarized from November to December.
