Starting from January 1, 2024, the Eurasian Patent Organization will adjust the amounts of fees for legal and other actions related to Eurasian patent applications and Eurasian invention patents.
The adjusted fees of the Eurasian Patent Organization are as follows:
Eurasian patent application fees
According to Article 15(2) of the Eurasian Patent Convention (“the Convention”), the following fees shall be paid for filing a Eurasian patent application: (1) A uniform procedure fee of 50,000 rubles for filing a Eurasian patent application; (2) According to Article 24(7) of the Patent Regulations under the Eurasian Patent Convention (“the Patent Regulations”), a fee of 5,500 rubles for each claim exceeding the fifth claim; a fee of 6,000 rubles for each claim exceeding the twentieth claim; a fee of 7,000 rubles for each claim exceeding the fiftieth claim; (3) According to Article 211(6) and Article 71(3) of the Patent Regulations, an additional fee of 5,000 rubles for late submission of a Russian translation of a Eurasian patent application; (4) An additional fee for late submission of a confirmation document for payment of the uniform procedure fee within the time limit specified in Article 211(7), Article 34(5) and Article 71(3) of the Patent Regulations, and an additional fee for each claim exceeding the fifth claim within the time limit specified in Article 24(7) of the Patent Regulations - fixed at 50% of the amounts of the fees listed in (1) and (2).
Eurasian patent application substantive examination fees
According to Article 15(6) of the Convention, the fees for substantive examination of a Eurasian patent application are as follows: (1) For one invention, the fee is 50,000 rubles; (2) For a group of inventions, the fee is 50,000 rubles, plus 30,000 rubles for the second independent claim, and 15,000 rubles for each subsequent independent claim.
Eurasian patent grant fee
According to Article 15(10) of the Convention, a fee of 30,000 rubles shall be paid for granting a Eurasian patent and publishing it in accordance with Article 51(1) of the Patent Regulations. According to Article 47(3)(5) of the Patent Regulations, an additional fee of 5,000 rubles shall be paid for late payment of the Eurasian patent grant fee.
Fees for supplementing, clarifying, correcting and amending patents
According to Article 49(2) of the Patent Regulations, when submitting supplementary documents containing requests for amendments and corrections before the completion of the formal examination of a Eurasian patent application, an additional fee of 5,000 rubles shall be paid for each request for amendment and correction.
According to Article 49(2) of the Patent Regulations, when submitting supplementary documents and requests for amendments and corrections after the date of completion of the formal examination of a Eurasian patent application, an additional fee of 13,000 rubles shall be paid for each request for amendment and correction.
According to Article 57(1) and Article 57(2)(2) of the Patent Regulations, when amending and correcting a Eurasian patent, a fee of 5,000 rubles shall be paid for each amendment and correction.
If amendments are made in accordance with Article 53(9) of the Patent Regulations after the examination of the opposition to the grant of a Eurasian patent, or in accordance with the request of the patent owner to limit the Eurasian patent made in accordance with Article 55(5) of the Patent Regulations, then a fee of 8,500 rubles shall be paid for publishing a new Eurasian patent specification.
According to Article 49(3) of the Patent Regulations, when submitting other independent claims that are included in the missing ones after the date of completion of the formal examination of a Eurasian application, a fee of 30,000 rubles shall be paid for each additional claim.
According to Article 49(2) of the Patent Regulations, after the date of receipt of a Eurasian patent application by the Eurasian Patent Office, if a request is made to change the information contained in the Eurasian patent grant request, and to change the applicant, patent owner or representative of other interested parties, except for the cases provided for in Article 6(1) to Article 6(5) and Article 6(11) of the Fee Regulations, a fee of 1,000 rubles shall be paid in accordance with Article 30(5) of the Patent Regulations.
According to Article 58(1)(1) of the Patent Regulations, if a request is made to change the information on the name or designation, residence or location of the patent owner in the Eurasian Patent Register, a fee of 2,500 rubles shall be paid.
Fees for appealing against decisions of the Eurasian Patent Office
According to Article 48(3) of the Patent Regulations, when appealing against a decision of the Eurasian Patent Office, a fee of 30,000 rubles shall be paid. According to Article 53(5) of the Patent Regulations, when filing an opposition to the grant of a Eurasian patent, and when issuing a notice of revocation of the extension of the term of a Eurasian patent in accordance with Article 16(7) of the Patent Regulations, a fee of 60,000 rubles shall be paid.
According to Article 16(8) and Article 53(8) of the Patent Regulations, when appealing against a decision of the Eurasian Patent Office, a fee of 80,000 rubles shall be paid.
Fees for extending missed deadlines and restoring rights
For the extension of the deadlines for the performance of procedural actions established by the Eurasian Patent Office, the following fees shall be paid in accordance with Article 37(2) of the Patent Regulations: (1) Within 12 months after the expiration of the deadline for submitting the required supplementary documents - 1,500 rubles per month for the first 2 months of the extension, and the fee for each subsequent month increases by 1,500 rubles compared to the previous month; (2) If the deadline is exceeded by more than 12 months, then from the 13th month, the fee for each month increases by 2,000 rubles compared to the previous month.
According to Article 37(3) of the Patent Regulations, when filing a request for continuation of the application, a fee of 25,000 rubles shall be paid.
According to Article 39(2) of the Patent Regulations, when filing a request for restoration of the Eurasian patent right, a fee of 50,000 rubles shall be paid in accordance with Article 39(1) of the Patent Regulations.
Fees for the transfer of the Eurasian patent application right or the Eurasian patent right
When filing a request for registration of the transfer of the Eurasian patent application right as a result of inheritance or reorganization of a legal entity, a fee of 5,000 rubles shall be paid in accordance with Article 13(5) of the Patent Regulations, or, in accordance with Article 7(1) of the Patent Regulations, a fee of 5,000 rubles shall be paid when acquiring the right.
When filing a request for registration of the transfer by way of assignment of the Eurasian application right, a fee of 20,000 rubles shall be paid in accordance with Article 13(5) of the Patent Regulations.
When filing a request for registration of the transfer of the Eurasian patent right as a result of inheritance or reorganization of a legal entity, a fee of 10,000 rubles shall be paid in accordance with Article 13(5) of the Patent Regulations, or, in accordance with Article 7(2) of the Patent Regulations, a fee of 10,000 rubles shall be paid when acquiring the right.
When filing a request for registration of the transfer by way of assignment of the Eurasian patent right, a fee of 40,000 rubles shall be paid in accordance with Article 13(5) of the Patent Regulations.
Other fees will remain unchanged.
