The popularity of a nursery rhyme video posted by two kindergarten teachers has led to legal troubles, sparking a copyright controversy. While the videos have become internet sensations, they have raised questions about who owns the rights to the nursery rhyme.
The videos feature the teachers singing and playing a finger game with their students to Jay Chou’s song “Listen to Mom’s Words”. The Wuhan-based teacher received rewards during her live broadcasts, and the videos have amassed millions of views and followers on social media platforms.
However, the videos have also sparked controversy about who owns the rights to the nursery rhyme. Online sources suggest that the original creator of the lyrics is a user named Wang Xiaoling, who posted a video of the song called “Little Garden” on Douyin, a short video app. The teacher from Hangzhou claimed to have learned the finger game online and sang it with Jay Chou’s melody.
A lawyer clarified that the teachers infringed on the musical and literary rights of Jay Chou and Wang Xiaoling by using their melody and lyrics without their consent. The teacher from Wuhan also violated the portrait rights of Su Su, who wrote and composed “Little Garden”, by earning money from live broadcasts.
According to Article 48 of the Copyright Law, using another person’s work without their permission through information networks constitutes an infringement. The original creators can demand an apology, compensation, or other civil liabilities from the infringers.
The lawyer urged people to respect intellectual property rights and avoid using other people’s original works for commercial purposes without authorization, as it could lead to legal repercussions.
