The National Intellectual Property Administration recently issued the reply to Recommendation No.2505 of the Fifth Session of the 13th National People's Congress, with an emphasis on continusing to strengthen the obligation to use trademarks, to fill the gap while adhering to the existing registration system, and to focus on calibrating the balance trademark registration and usage.
The Reply proposed the further solidification of the concept of trademark usage with its foundamental position. On the basis of retaining the original withdrawal system, it also studies the feasibility of introducing the system of trademark usage commitment and voluntary submission of usage description during the existence period. It further suggested adding provisions on trademark revocation ex officio. For trademark registrants who fail to fulfill their usage commitments, to submit descriptions of usage according to law, and had improperly exercised the exclusive right to use the trademarks, their registered trademarks shall be revoked ex officio.
