Supreme Court to Provide Judicial Service and Safeguard for Unified National Market

On July 25, the Supreme Court issued the Opinions on Providing Judicial Services and Guarantees for Accelerating the Construction of a Unified National Market (hereinafter referred to as the Opinions) and the related typical cases. 

In its seven chapters, the Opinions stipulate ways to abide by the latest policies of the central government, adjudge the objectives and tasks, and clarify the role of the court in the construction of a unified national market from a scientific perspective. It also aims to strengthen the unified and equal protection of market subjects, help to build a unified market of factors and resources, maintain the unified market trading rules according to law, promote the high-level unification of goods and services markets, and maintain a unified market competition order. 

According to the Opinions, legitimate rights and interests of Chinese and foreign parties should be equally protected according to law, and judicial protection of intellectual property rights should be strengthened. The Opinions also propose more strict system of punitive damages and behavior preservation for intellectual property infringement to effectively curb intellectual property infringement, support the construction of a unified technology and data market, and combat monopoly and unfair competition according to law. It further strengthen judicial management of anti-monopoly and anti-unfair competition to prevent monopolistic behaviors such as monopoly agreements and abuse of market dominance according to law, while severely cracking down on unfair competition behaviors such as infringement of trade secrets, malicious hijacking of trademarks and counterfeiting, and strengthening the trial of unfair competition cases in key areas such as scientific and technological innovation, information security and people's livelihood security.
