On September 1, 2021, the Measures for the Administration of the List of Serious Violations and Dishonesty in Market Supervision and Management came into effect. The Measures clarifies that parties engaged in intentional infringement of intellectual property rights, or submission of abnormal patent applications and malicious trademark registration applications that harm the public interest, or illegal patent and trademark attorney acts, shall be blacklisted for serious violation of laws and dishonesty.  

So far a total of 14 parties in seven provinces (autonomous regions and municipalities), including Zhejiang, Jiangsu and Anhui, have been blacklisted for serious violations of laws and dishonesty due to infringement of the exclusive right to use trademarks and intentional refusal to fulfill the administrative decisions. 

According to the Measures, administrative duties shall be imposed on parties, as the key supervision objects, blacklisted for serious violations of laws and dishonesty, including increase the frequency of inspections, cancelling honorary titles and other management measures. At the same time, examination will be given on administrative licenses, qualifications and qualifications, entrusting government procurement projects and project bidding, and joint punishment will be carried out according to laws and regulations.
