On July 21, 2021, the National Intellectual Property Administration published the Summary and Analysis of Administrative Litigation of Trademark Review and Adjudication Cases in 2020 (hereinafter referred to as "Analysis").
According to the data published in Analysis, in 2020, the review department of the Trademark Office ruled a total of 358,300 cases, and received 14,977 notices of responding to the first instance in the whole year, accounting for 4.18% of the total ruling, a number basically consistent with the last year. A total of 5,933 notices of responding to the second instance were received, a slight increase over last year. In 2020, 939 cases entered the retrial hearing procedure or retrial procedure of the Supreme People's Court and Beijing Higher People's Court. Compared with the previous year, the year 2021 saw a significant increase in number of retrial cases.
In 2020, the overall losing rate of review cases (Trademark Office) was 24.62%, while the actual losing rate after excluding the change of circumstances was only 9.8%, a significant drop compared with the last year (13.9%). This statistical result shows that the trademark review department and the court are stable and unified in the applicable standards of law to a certain extent.
