Court Ruled Against Chanel in LOGO Dispute VS Huawei

On April 21, 2021, the European Court of Justice ruled that Huawei LOGO did not constitute a trademark imitation of the luxury brand Chanel, and the two logos were not similar.

In 2017, Huawei applied to the European Intellectual Property Office (EUIPO) to register the above graphic trademark on "computer hardware" and other commodities, but Chanel claimed objection to this application, arguing that Huawei's applied trademark is similar to Chanel’s logo.

However, in the judgment of the European Court of Justice on April 21, 2021, the European Court of Justice held that Chanel's logo was a double C pattern wound in horizontal direction, while Huawei's registration was a vertically wound semi-ring, which was unlikely to cause confusion among the public, hence the court ruled against Chanel's objection.

As the world-renowned enterprises, Chanel and Huawei had aroused great attention for their dispute. Due to the slight differences in the examination standards of graphic trademarks in various countries, the trademark objection lawsuits of Chanel logo and Huawei logo in the European Union are of great reference significance to many foreign applicants.
