A major revision and improvement had been recently made by Jiangsu High Court to the Guidelines for the Trial of Trademark Infringement Disputes issued in 2011.

With the development of economy and society, the continuous progress of science and technology, and the emergence of new business models, new cases and problems involving trademark infringement are constantly emerging. Recently, the Jiangsu High Court has conducted a major revision and improvement on the Guidelines for the Trial of Trademark Infringement Disputes.

In general, this revision has the following characteristics:

1. The revised edition absorbs and is consistent with the latest laws, regulations, judicial interpretations and other contents such as the Civil Code and Trademark Law;

2. The revised edition supplements relevant contents such as the determination of new trademark infringement acts and the regulation of Internet competition order arising from the development of new technologies such as the Internet and new business models;

3. The revised edition reflects the trial experience and judgment ideas accumulated by the court in the process of hearing trademark infringement cases;

4. The revised edition reflects the value guidance of strict punishment on malicious cybersquatting, repeated infringement and malicious litigation and judicial protection on intellectual property rights.
